1. Acceptance of Terms

By accessing or using Merry Moments ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Merry Moments is a privacy-first temporary photo sharing service. Users can create "moments" (photo collections), share links with guests, and collect photos from multiple contributors. All photos are automatically deleted after 72 hours.

3. User Accounts

To create moments, you must register for an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Prohibited Content

The following content is strictly prohibited and may result in immediate account termination and reporting to law enforcement:

• Child Sexual Abuse Material (CSAM) - Any sexual content involving minors is illegal and will be reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement
• Non-Consensual Intimate Images - "Revenge porn" or intimate images shared without consent
• Content depicting or promoting violence, terrorism, or self-harm
• Content that exploits, harms, or endangers minors in any way
• Content that promotes illegal activities or substances
• Malware, viruses, or other harmful code
• Content that infringes on intellectual property rights

5. Acceptable Use

You agree NOT to use the Service to:

• Upload any prohibited content listed above
• Harass, abuse, threaten, or harm other users
• Impersonate others or misrepresent your identity
• Attempt to gain unauthorized access to the Service
• Use automated systems, bots, or scrapers to abuse the Service
• Circumvent any security measures or access controls
• Violate any applicable local, state, national, or international laws

6. Privacy-First Approach

Merry Moments is designed with privacy as a core principle:

• No proactive content scanning - We do not monitor or scan your photos
• Automatic deletion - All content is permanently deleted after 72 hours
• Minimal data retention - We only store data necessary to provide the Service
• No content access by staff - Our administrators cannot view your photos

However, this privacy-first approach does not protect illegal activity. We will cooperate with law enforcement when legally required.

7. Reporting & Law Enforcement

Abuse Reporting: If you encounter prohibited content, please report it immediately to abuse@merrymoments.cc.

Legal Obligations: We are legally required to:

• Report any known CSAM to the National Center for Missing & Exploited Children (NCMEC)
• Cooperate with valid legal requests, court orders, and subpoenas
• Preserve evidence when required by law

User Responsibility: You are solely responsible for the content you upload. By using this Service, you represent that your content does not violate these Terms or any applicable laws.

8. Content Ownership

You retain ownership of all photos you upload. By using the Service, you grant us a limited license to store and display your photos for the purpose of providing the Service.

This license terminates when your photos are deleted (automatically after 72 hours or manually by you).

9. Photo Deletion

Important: All photos are automatically and permanently deleted 72 hours after the moment is created. This deletion is irreversible.

It is your responsibility to download any photos you wish to keep before they are deleted. We are not responsible for any loss of photos due to the automatic deletion feature.

10. Service Limits

The free tier includes:

• Up to 3 active moments at a time
• 1 GB storage per moment
• 30 photos per guest uploader (500 for moment creators)
• 72-hour photo retention

We reserve the right to modify these limits at any time.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of photos, data, or profits.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason. You may also delete your account at any time.

14. Changes to Terms

We may modify these Terms of Service at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

15. Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
